Notice Period
- 30-Day Notice Requirement: Clients must provide a written notice of cancellation or termination of services at least 30 days before the intended end date of the services. This notice period allows the company to wrap up ongoing campaigns, finalize any work in progress, and manage transition processes effectively.
Cancellation Procedure
- Written Notice: The notice must be sent via email to [insert email address here] or by certified mail to [insert mailing address here]. The notice should include:
- Client's name
- Client's address
- A phone number for contact
- Identifying details for the services being canceled
- An explicit statement of intent to cancel the services.
Effective Date of Cancellation
- The effective date of cancellation shall be at least 45 days after the receipt of the written notice, ensuring that the notice period aligns with the business's operational requirements and compliance with Virginia law.
Rights Upon Cancellation
- Ongoing Services: Any services or campaigns that were scheduled or in progress at the time of cancellation will be completed unless otherwise specified in the cancellation notice by the client.
- Data and Access: Upon cancellation, EngagedHeadhunters.com will provide the client with all relevant data, reports, and access to any digital assets created during the service period, subject to any existing agreements regarding intellectual property rights.
Non-Renewal
- If the client chooses not to renew the services, they must notify EngagedHeadhunters.com at least 30 days before the end of the current service term. If no notice is received, the services will automatically renew for another term as per the original contract.
Exceptions
- Material Breach: If either party materially breaches the terms of the service agreement, the other party may cancel the contract without the standard notice period, provided the breach is not cured within a reasonable time after notification.
- Legal Compliance: The policy must comply with Virginia's consumer protection laws, which allow for some exceptions in terms of cancellation rights, particularly related to the right of rescission for purchases made outside of a retail setting.
Review by the Commissioner
- Under Virginia law, if a notice of cancellation or refusal to renew is issued, the client has the right to request a review by the Commissioner of Insurance within 15 days from receiving the notice. If the review finds that the cancellation or nonrenewal was not compliant with state laws, the policy might be required to be reinstated, but the Commissioner does not make underwriting judgments.
Post-Cancellation
- Attorney Fees: If the Commissioner finds in favor of the insured (client), EngagedHeadhunters.com might be required to pay reasonable attorney fees as per the discretion of the Commissioner
- Record Keeping: EngagedHeadhunters.com must maintain records of all cancellations and refusals to renew for at least one year, including copies of all notices sent to clients.
